Mate make sure you get court appointed aid trav! Tell whoever that might be what happened, don't bullshit to em because they've heard it all before, let them explain how you need the car for work ect! The judge has no discretion now in these matters, so he cannot give you a lesser or greater suspension period than the reading, .13 means one year three months. What the Judge has discretion over is the fine trav, some heavy arse kissing is required here, play your cards right and 600 should pull it up.
I'm fairly sure that's incorrect. As during my drink driver education course they told us that it doesn't matter if your only going to your car to get something out. The police can still get you for being under the influence whilst having control of a car. Likewise sleeping in your car. Yes sounds silly but there is intent that you may drive once in the car or knock something i.e handbrake thus moving the car.
But what if your going to the passenger side? Cos thats like saying you cant drive your car with a drunk passenger
Firstly... ...it depends whether you're parked on the road or private property. I think they'd be hard pressed getting a conviction if you went to your car to say get another slab from the boot. And if you do sleep off a bender in your car, just hide the keys first... and not in the car either, but not too clever, you may forget where you stashed em'. Egg

Mate take my advice, and go to court with a good solicitor who specialises in road traffic offences, its amazing what those blokes can do, im looking fairly confidently at an appeal to keep my licence after getting done for speeding and that on a good behaviour licence having already lost it twice, there is a few tricks like enroll in one of them advanced driving courses , get a letter from your employer saying your job depends on being able to drive, trust me on this one, if you get a solicitor on it, there will be no walking for you
What an idiot! i respect a cockaroach more then someone who drinks and drives And it doesnt matter how much you drank, anything over 0.05 is proven to be harmful not only to yourself but to other road users because even if you wanted to, you dont have all the normal responses and reactions as you would if you were sober. Too many people die in our country due to drinking and driving and the majority of them poor innocent people who are minding their own business and using the roads. And i dont care if your not up for lectures you poor baby. If you dont want a lecture then you shouldnt have posted up. The only sympathy i have for drink drivers is the fact they are so lame. Hope you have learnt your lesson for everyone elses sake that use the roads.
That might happen in QLD but its not the case down here. Sorry but its black and white in victoria, there are no exceptions! Buying an expensive mouth is just a waste off money, he will not be getting a work licence, his licence is gone for 13, plus the fine.
This is getting a bit heated now. Mate, you shouldn't have punched it. I'm tipping this isn't your first time driving after a few. I know the feeling, freeze your nuts in the 300 or risk driving home? It's all too easy to drive home.... You might have to also pay for the poles you bent over.
Oh.. and dude, you're lucky you didn't hurt anyone. Did you see that story on Australian Story where the guy was drink driving and he killed some other bloke? After the accident he dedicated his life to talking to kids about drink driving and the consequences. He still got screwed in court and is now in jail. well i know first hand how hard it is not having a lisence. 3 1/2 months through my 6 month suspension for speeding (not in my Z) Whenever i drink i didn't go near my Z for that reason, too easy to try the big man stuff and lose it and all hell breaks lose.
