Just had a few talks with some family members of mine with legal persuasions and I would like to add the following points to this thread.

Should people go down the track of filing small claims, apart from being very lengthy and although they would likely end in getting some money back, they could also put Jason into a very difficult situation which I would like to try and avoid as long as it is possible.

collecting information and recording it in a database will unify our effort and potentially add to the likelihood of an outcome for everyone rather than just for some.

one of the major benefits of sticking together for now is clarity. We will have a detailed summary of where we stand and I will forward that summary on to Jason which will hopefully make it clear to him where he stands also.

this will hopefully put us all in a position where we can come to an arrangement that works as best as it can for all.

so as Ive said before, I'm still happy to create the database, I have three members input so far, and Ill make this information available to all etc etc.

Yea, I wasnt really wanting to go for legal action, simply because i dont want to have to put anyone in a spot like that... but if we have a list of all the info and amounts etc, and we send that, maybe it will make him realise that we are getting impatient, with the lack of phone calls being returned etc....

    Hmm

Lol. Why would there be talk of legal action if they hadn't paid?

Yeah I skimmed, I didn't realize people actually fronted money I thought everyone was just waiting to hear back from an EOI. Shit!

I must say though, I wouldn't of laid down any money personally until I saw photos of someones garage full of body kits. That's just me though, wicked scam you have to admit. I cant think of much else that is more expensive than what that kit would be going for.

Yeah, true that, not exactly pennies. I don't really want to talk shit about the seller, since a)i don't know him and b)i didn't pay for the kit.

But i can't even imagine how those that did pay are feeling right now..

Talking shit about people you dont know, about something you're not involved in is the best kind of shit to talk. We're the unbiased torch carriers throwing stones with the broken hearted. I think the technical term is "Fluff Girls" haha!

This one registered off the scale on the "too good to be true" meter... I am amazed that the people involved (the scamees if you will) have given him this much rope, because he's allegedly a "good bloke"??

This whole episode is very sad.

Firstly, I don't believe that there was ever any intent on Jason's part to scam people, however, circumstances beyond his control, changed things dramatically(He, like many others, had his company crippled by the "Horse Flu" epidemic last year, and has apparently suffered great difficulty since then).

Secondly, Jason has handled the current situation in a completely unsatisfactory fashion(due in no small part, to his embarrassment at his inability to find a way to make good on these transactions). "Going to ground" is not a solution, and never will be.

Time doesn't heal these things(but neither do comments and allegations from non-involved or ill-informed individuals), it only makes things worse.

A very dear friend once told me that "The road to Hell, is paved with good intentions". That has never been more true, than in this issue, IMHO.

Thats probably the biggest worry when it comes to buying things off of this forum, i do have a lot of trust in people on here who i have purchased items from, and sold items to... i don't know the full circumstances of the situation. But if it is because his flat broke/Bankrupt then sure that would be embarressing but not as embarressing as having a forum of people think your a scam artist, looks like its too late for explinations and agreements though. Those people you havent contacted do have the right to take it to small claims court and most likely will win which will probably result in more loss of money on your part....

I gues what i'm trying to say is giving them a little heads up may have helped, people here are pretty understanding but you cant ignore them and expect it to be all good.

I have to disagree Chili (as per usual :))

I can only presume Jason has just spent everyones money. I cannot see any other reason why he wouldnt of just returned it by now otherwise. Can you? Heaps of us here have done group buys for the forum, and it would be unthinkable to us to "dip into" the money we have collected for our own personal use. To cross that line is what has seperated "good intentions" from plain criminal activity.

I think forum members have every right to comment and make judgement. Certainly Jason isn't willing to appear here and set the record straight, its not as if he doesnt know what is being said. This not only impacts on those involved but also on the willingness of other forum members to part with their money in future group buys for fear of the same occuring. Group buys can't occur typically without the money upfront, so if everyone is afraid of getting scammed, then no more group buys and we all suffer.

If I was involved I would of pursued this to the fullest extent of the law. I am really suprised no one has at this stage, and I wish them the best of luck recovering their money.

regardless there comes a point at which he chose to spend forum members money, where he should have simply returned it. This choice was totally within his control.

How conveniently you and Nathan choose to disregard my comments,

If you intend to quote me, quote me in full(please don't take me out of context).

The remarks(yours and Nathan's) concerning Jason spending the money improperly, is pure speculation on your parts(it may well turn out to be correct, but it is yet to be proven), and if he was to be forced into bankruptcy, it is possible that no one will recover their money, so discretion would be better than assumption at this point, don't you agree?

    Nope, still disagree :)

I read your comments, but they are skirting around the elephant in the room. That Jason spent the money. It has nothing to do with embarrassment that he couldnt source the parts, no one would of cared. Speculation or not, its by far the most obvious and likely reason.

I cant understand why your trying to defend someone who has clearly and unquestionably ripped off thousands and thousands of dollars from forum members. Being "discrete" has not gotten any of these forum members there money back has it?
